Privacy policy

This privacy policy governs your use of the software application Parking Sms Scheduler  (“Application”)  for mobile devices, which is created by Goran Širić.

Parking SMS Scheduler is Android application for paying parking over SMS parking messages in cities which have implemented m-Parking system.

This Privacy policy is effective as of December 28th, 2023.

Permissions Required by the Application and Their Use

Aplication requires the following permissions to function effectively and provide you with our full range of features:

SEND_SMS
This permission allows Application to send SMS messages without user interaction to facilitate parking fee payments. It is particularly crucial for enabling payments for multiple hours of parking. By sending your car registration details to a designated number through the app, you can conveniently pay for extended parking durations as needed

READ_SMS
This permission enables the Application to automatically read confirmation SMS messages from the parking service, confirming payment and parking duration. . The Application will exclusively access messages sent from the designated parking payment system numbers, ensuring user privacy and data security.

READ_PHONE_STATE:
This permission is required for the Application to detect the presence of dual SIMs in your device. It ensures the app functions correctly by allowing you to choose which SIM card to use for sending SMS messages, particularly important for devices with multiple SIM cards.

ACCESS_FINE_LOCATION:
This permission allows the app to access your precise location. It's critical for identifying the correct town and parking zones and ensuring accurate billing for the parking services you use.

POST_NOTIFICATIONS:
This permission enables the app to send notifications to your device. These notifications may include important alerts about your parking status, reminders, or updates related to the app.

What information does the Application obtain and how is it used?

User Provided Information 

The Application obtains the information you provide when you use the Application.

When you use the Application, you generally provide (a) your email address (e) information you enter into our system when using the Application, such as contact information and your defined parking zones information.

We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.

Automatically Collected Information 

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your devices unique device ID, the IP address of your device, your operating system, the type of Internet browsers you use, and information about the way you use the Application. 

Does the Application collect the parking confirmation SMS messages? 

This Applicationw collect parking confirmation SMS messages, in order to create map of parking zones in cities. All confirmation parking SMS messages are anonimized. That mean mean that all personal personal information (such as IP or Vehicle registration) are removed from the confirmatoin parking SMS message before it is transmitet to Website.

Does the Application use precise real time location information of the device?

This Application user information about the location of your mobile device to detect city, create maps of zones for and provide you possible parking zones for your current location.

Do third parties see and/or have access to information obtained by the Application?

No. We do not share any data collected by our app with third parties. The information you provide within the app, including location, SMS, and phone state data, is used solely for the purpose of delivering and enhancing the services provided by our app.

While our application does not share your data, we utilize Google Mobile Ads to display advertisements. It's important to note that Google Mobile Ads may collect, use, and share certain information for advertising purposes as per their policies.
This information may include, but is not limited to, device identifiers, location data, and usage data, which helps in providing targeted advertising experiences.
The collection and use of data by Google Mobile Ads are governed by Google's privacy policies and are outside the control of our application.

We may disclose User Provided and Automatically Collected Information:

• as required by law, such as to comply with a subpoena, or similar legal process;

• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

• with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

• to advertisers and third party advertising networks and analytics companies as described in the section below

Automatic Data Collection and Advertising

We may work with analytics companies to help us understand how the Application is being used, such as the frequency and duration of usage. We work with advertisers and third party advertising networks, who need to know how you interact with advertising provided in the Application which helps us keep the cost of the Application low. Advertisers and advertising networks use some of the information collected by the Application, including, but not limited to, the unique identification ID of your device and your mobile telephone number. To protect the anonymity of this information, we use an encryption technology to help ensure that these third parties can’t identify you personally. These third parties may also obtain anonymous information about other applications you’ve downloaded to your mobile device, the mobile websites you visit, your non-precise location information (e.g., your zip code), and other non- precise location information in order to help analyze and serve anonymous targeted advertising on the Application and elsewhere. We may also share encrypted versions of information you have provided in order to enable our partners to append other available information about you for analysis or advertising related use. 

This does not mean that all Personal Data are used for this purpose. Information and conditions of use are shown below.

Some of the services listed below may use Cookies to identify Users or they may use the behavioral retargeting technique, i.e. displaying ads tailored to the User’s interests and behavior, including those detected outside this Application. For more information, please check the privacy policies of the relevant services.

    AdMob is an advertising service provided by AdMob Google Inc.

 • Analytics

    The services contained in this section enable the Owner to monitor and analyze web traffic and can be used to keep track of User behavior.
    Google Analytics with anonymized IP (Google Inc.) • Google Analytics is a web analysis service provided by Google Inc. (“Google”).
    Google utilizes the Data collected to track and examine the use of this Application, to prepare reports on its activities and share them with other Google services.
    Google may use the Data collected to contextualize and personalize the ads of its own advertising network.
    This integration of Google Analytics anonymizes your IP address.
    It works by shortening Users' IP addresses within member states of the European Union or in other contracting states to the Agreement on the European Economic Area.
    Only in exceptional cases will the complete IP address be sent to a Google server and shortened within the US.

What are my opt-out rights?

There are multiple opt-out options for users of this Application:    

Opt-out of all information collection by uninstalling the Application: You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. 

Opt-out from the use of information to serve targeted advertising by advertisers and/or third party network advertisers: you may at any time opt-out from targeted advertising by disabling serving tareted ads from Applicatoin settings section in the application or by uninstaling application.

Opt-out from the use of information about your location: you may at any time opt-out from further allowing us to have access to your location data by disabling  location services on your device.

The purposes of the processing for which the Personal Information is intended	Your Personal information may be used by us for administrative, analytical, research, optimization, security and other purposes. Personal Information is collected in particular in order to: - provide you with any goods, services, or functionality you've requested or respond to any inquiries you've made - administer the Application - enable your use of the services available on The Website; - personalize your content by learning more about using Application; - send you general (non-marketing) commercial communications; - send important Service announcements concerning any temporary Application outages, plus any maintenance issues that may affect the level of our service; - send you email notifications which you have specifically requested; - be able to reply to your questions and concerns which were sent to our support center; - be able to contact you for the purpose of providing with technical assistance and support; - provide further security according to your local necessities; - to enhance and enrich your experience in the Application - your device ID may be used so we can send you push notifications (if you choose to allow that function); - establish, exercise or defend a legal claim. Your Personal Information is processed for the above mentioned purposes as it is necessary for the performance of Service (Article 6(1)(b) of the GDPR) or it is necessary for the purposes of the legitimate interests pursued by the controller, which is data analytics and establishing, exercising or defending a legal claim (Article 6(1)(f) of the GDPR). If you gave us your consent we might send you the newsletter and other marketing communications, relating to Application or the businesses of carefully-selected third parties. You have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
Rights of the data subject under GDPR	The right to access: You have the right to access to your Personal Information and information about how your Personal Information is being processed. If you request it, we will provide an overview of the categories of data being processed, a copy of the actual data and details about the processing. Providing you with a copy of Personal Information is free of charge (a reasonable fee can be charged for further copies). The right to rectification: You have the right to have your Personal Information rectified if it is inaccurate or incomplete. You can object to the processing of your data whenever the processing is based on the controller’s legitimate interest. The right to data portability: You have the right to obtain (in a machine readable format) your Personal Information that you have provided to us for the purpose of transferring it from one controller to another, without being prevented from doing so. The right to erasure: When data is no longer relevant to its original purpose or where you have withdrawn consent or where the Personal Information have been unlawfully processed, you have the right to request that your data be erased. The right to erasure can be however refused by us i.a. where the Personal Information is processed for archiving purposes in the public interest (for example, scientific research), where data is necessary for legal defense, or to comply with a legal obligation. The right to erasure can also be denied where the data is necessary to exercise the right of freedom of expression. The right to restrict processing: You have the right to restrict the processing of your Personal Information in cases where you have contested its accuracy; where you have objected to the processing but we have a legitimate ground which overrides this right; where the processing is unlawful but you request restriction instead of erasure; or where the data is no longer needed but you need it to establish, exercise or defend a legal claim.
The period for which the Personal Information will be stored	Your Personal Information is stored as long as we provide you the Service and as it is necessary for the establishment, exercise or defence of any legal claims, however no longer that for 10 years from the moment of the termination of the agreement concerning Services. Your Personal Information may be processed longer only if it is necessary to fulfil our legal obligation.
The recipients or categories of recipients of the Personal Information	Your Personal Information might be processed by the service providers (data processors) of the controller, which act solely on the instructions of the controller (e.g. IT service providers, data analytics providers). We may transfer your Personal Information outside of the European Economic Area (EEA), in particular to US, Canada, Singapore, Australia, China, India, Japan, Russia, Brazil and South Korea only when we have legal basis to do so, i.e. when the country or region the data is being transferred to has an “adequate” level of personal data protection by EU standards, or where not considered adequate, under the use of standard contractual clauses (SCCs) or, in regards to data transfer to the US, if the data processors adhere to the EU-US Privacy Shield.
Necessity of provision of Personal Information	The provision of Personal Information is necessary to deliver the Service.

 

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at goran.siric@izvornikod.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at goran.siric@izvornikod.com. We will delete such information from our files within a reasonable time.

 

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

 

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

 

Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the Croatia. If you reside outside the Croatia your information will be transferred, processed and stored there under Croatian privacy standards.
